Iowa is the third state to have equal marriage, after Massachusetts and Connecticut.
In a unanimous ruling, the Iowa Supreme Court Friday said that the state law banning same-sex marriage is unconstitutional - upholding a lower court ruling.

“The Iowa statute limiting civil marriage to a union between a man and a woman violates the equal protection clause of the Iowa Constitution,” the justices said in the 69 page ruling.
The court also discounted civil unions as an alternative to marriage.

“A new distinction based on sexual orientation would be equally suspect and difficult to square with the fundamental principles of equal protection embodied in our constitution,” the ruling said.
The decision means that gay and lesbian couples may immediately obtain marriage licenses and be allowed to marry under Iowa law in 21 days.
Several hundred people - supporters and opponents of same-sex marriage - gathered outside the courthouse for the release of the ruling. A number of state troopers also were on hand, guarding the entrance to the building.
When the ruling was issued gay rights supporters let out a massive cheer.
At the Legislature, Republican leaders renewed calls for a constitutional amendment banning same-sex marriage. But some GOP members said that in the days remaining in the session the focus should be on the economy.
Democrats who are in control of both houses and the governor’s mansion said they would not suspend the rules to deal with a proposed amendment.
“Today is a red letter day for the state of Iowa,” said openly gay state Sen. Matt McCoy (D) . “All of Iowa’s citizens now have equal protection under the law. Thousands of Iowans who have worked hard, raised families, and paid taxes will now be afforded the opportunity to marry.”
“As a life long Iowan, I know that fair minded people throughout our state support equality for all. I have never been more proud of all the Iowans who have worked continuously for the advancement of human rights for all,” McCoy said in a statement.
Among the opponents of gay marriage gathered at the courthouse was Bob Vander Plaats, a GOP candidate for governor. Vander Plaats said the ruling will be a factor in next year’s gubernatorial election.
He accused Democratic Gov. Culver and the Legislature of dragging their heels on pushing for a constitutional amendment defining marriage as being between a man and a woman. If they had gotten on with it “we wouldn’t be dealing with this today,” he said.
Six same-sex couples sued in 2007 for the right to marry. Polk County Judge Robert Hanson struck down the state Defense of Marriage lawn declaring it to be unconstitutional. Later the same day Hanson stayed the ruling pending an appeal.
The state Supreme Court heard oral arguments in the case last December.
Assistant Polk County Attorney Roger Kuhle argued that Hanson had overstepped his authority.
Kuhle also said that state support of same-sex marriage would damage traditional marriage, arguing that it would indicate to future generations that marriage is no longer about procreation.
“One could easily argue, and we do, that fostering same-sex marriage will harm the institution of marriage as we know it,” Kuhle told the justices. “It’s not going to happen tomorrow. We’re not going to see any changes tomorrow, next week, next year, in our generation. But you’ve got to look to the future.”
Lambda Legal attorney Camilla Taylor, representing the six couples who challenged the ban on gay marriage, told the court that the law violates Iowa’s constitution.
Taylor said that the constitution protects gay people’s rights to due process and equal protection.
Dennis Johnson, a former Iowa Solicitor General and now a Des Moines lawyer who also represented the same-sex couples, disputed Kuhle’s arguments that there would be long-term detrimental effects to gay marriage as “highly speculative”.
“The question is: Why are same sex couples kept out?” Johnson asked. “They have families, they would benefit from the stability, the financial stability. Their children would benefit.”
A poll released last year in Iowa found that a majority of people in the state support gay couples rights but are divided on whether that should be marriage or civil unions.
The poll, by the University of Iowa, found that 28.1 percent of those surveyed support same-sex marriage, while another 30.2 percent support civil unions but not marriage. A third of those questioned oppose any recognition of same-sex couples, with about 10 percent having no opinion or refusing to answer.
In a separate case the Iowa Supreme Court ruled in 2008 that co-adoptions by same-sex parents were legal.
The case involved a lesbian couple who had split up. While they were together one partner had adopted as a co-parent the children of her partner. When the relationship ended the birth mother asked a court if the other woman had visitation rights and could be compelled to pay child support.
A lower court ruled that co-adoptions by same-sex couples were illegal and threw out the case. The Supreme Court disagreed and ordered the lower court to revisit the case.
Friday’s ruling makes Iowa the third state to have legalized gay marriage. The other two are Massachusetts and Connecticut. The Vermont House on Thursday approved gay marriage but the Republican governor has threatened a veto.
Same-sex marriage was overturned in California in November by voters and a challenge was filed in the state Supreme Court. A ruling is expected within the next 60 days.

As a gay man, I commend your efforts to stop your state from allowing gay marriage from ever becoming a reality.
This whole gay marriage thing is nothing more than a sham and will surely cause more problems when gay people have many more disagreements than the average straight person does, I can only wonder what the courts are going to have to deal with and go through when a gay person files for divorce every day of the week and how will the courts decide who the women is when it comes down to dividing the money and property, as it stands now, the women gets everything but when it comes to gay people, who will get what?
Gay men especially fall in love with different men every day and are not loyal to their partners, they constantly cheat on their lovers while all the while profession their love for their partners.
In my observation, I have also witnessed many gay men, having sex with under age children and when you bring this problem to their attention, they don’t see anything wrong with it, most gay men think with their head between their legs and not the one on their shoulders, they also don’t see the repercussions of their actions for having sex with underage children.
This will undoubtedly become a bigger problem if they are allowed to get marriage.
Please do whatever it takes to prevent gay people from ever getting gay marriage passed.

As a Gay man, I strongly oppose recognition of gay marriage and civil unions.
Gays and Lesbians have no right whatsoever to expect anyone to grant them the rights to marriage.
Marriage is defined as between a man and a women, not same sex people.
You are all hypocrites, several years ago, no one ever considered gay marriage or civil unions until it got media attention, all of a sudden everyone is jumping on the band wagon with this sham for gay marriage and civil unions.
Marriage equality and the other gay organizations should first focus on putting a stop to discrimination against gays and lesbians in the work place, restaurants, health care, walking down the street being abused verbally and physically, housing etc, before all of you hypocrites continue to push this senseless, waste of time gay marriage initiative.
As a gay man, I am greatly disappointed for the lack of concern all of you have when one of our so call brothers and sisters are being beating up on or killed and none of you ever come out and protest any of those problems, I like to know why?
The answer to that is, all of you are gutless cowards, who are greedy and don't have a brain in you head to realize that the politicians don't give a crap about us and never have, their only concern is how much money can be made and the voting block of potential voters that might or might not vote for them in any election, that's all but all of you are to stupid to see that.

I have known Christine Quinn for several years and she is currently the front runner to be the next Mayor of the city of New York in 2013.
I strongly disagree that Miss. Quinn has what it takes to be the next mayor of the New York City, how can we trust and expect her to run the city of New York as Mayor if she can’t even control her councilmembers from getting in to trouble, she has a tendency to look the other way when it involves her councilmembers.
Miss. Quinn also has a tendency to make empty promises and give false hopes to people in need., she really talks out of ass.
Some of her current councilmembers have been involved with stealing discretionary funds for their own personal use and have either been found to be guilty and who are currently in jails, she has also distributed those funds to fictions organizations.
Miss. Quinn’s track records for overturning the will of the people by allowing certain elective officials to continue running for the same office when the voters have spoken about term limits
Miss. Quinn’s platform was to clean up City Hall, but to date has done nothing to keep her word; she is too involved with making a name for herself and rubbing shoulders with business people, the very same people who are ripping off taxpayers every single day.
Miss. Quinn has stated several times that she was going to put a stop to the member items and pork slush funds but today hasn’t done a damn thing about it, she continues to align herself with corrupted, unscrupulous people and then there was her promise to protect each and every voter and give everyone a say in policies, but I guess that changed, because when she decided to push down the throats of the voters by forcing Gay Marriage, she has violated her trust and her duties, Miss. Quinn says that everyone has a say but when it involves something that efforts, her, then everyone else has no say in anything.
Miss. Quinn has violated the trust of the Gay Community and the voting public, she say one thing but does another, Miss. Quinn can’t be trusted with anything, she is nothing more than a lying, two face career polician, whose only concern is for herself and her image.

Dear Speaker Quinn:
I have attempted to reach out to you numerous times by phone, e-mail, and in person to get a full explanation as to why you’ve been repeatedly failing to respond to my complaints and concerns.
Please be advised of the following matters which are of great concern to me:
1) When I filed my lawsuit against the New York Yankees et al., you and Senator Tom Duane, and my friend, Daniel J. Dromm (currently a City Councilman) and various former and current Council Members promised me that you were going to help and support me. Unfortunately, such help and support never came about.
2) I complained to you about the safety issues in our parks as well as the ongoing illegal activities, and you never took any definitive action of which I’m aware. It was only regarding the recent Central Park rape situation that you finally took an interest. I can’t fathom why you had to wait until someone got seriously hurt in order for you to take action. Only now have you come out with a package of proposals to toughen penalties on sexual predators.

3) On September 8, 2012, I wrote to Mayor Bloomberg concerning NYC teacher Francesco Portelos. This letter was copied to you, Daniel J. Dromm (who is a member of the City Council Education Committee) and his staff, Tino Hernandez (the Chair of the Panel for Educational Policy), Robert Jackson (the Chair of the City Council Education Committee), Chancellor Dennis M. Walcott, and the Panel for Educational Policy. As of today’s date, Mayor Bloomberg has not responded. In addition, none of the recipients of the copies, including you, have acknowledged receiving a copy, or stated that you would independently look into the matter. Mr. Portelos’ situation, which has been mentioned several times in the media, reflects the fact that the NYC Department of Education has established mini “rubber rooms” to replace the former large ones. Can you answer the following question, “What sense does it make to keep Mr. Portelos and other good teachers in a mini ‘rubber room,’ essentially paying them to do nothing, when their skills would be better utilized in front of a class?” It is quite clear that Mr. Portelos was “set up” for having asked questions. I haven’t met Mr. Portelos, but I’ve been following his plight for some time now as recounted in www.protectportelos.org and in various news stories. Based on my previous research, I came to the conclusion that other teachers had been put into the same situation (i.e., “false imprisonment” in a “rubber room”) because they either reported some type of alleged misconduct by a school administrator, or had done something else to anger a school administrator. The people who are truly suffering by these improper banishments of good teachers to “rubber rooms” are the students. I also note that the taxpayers are footing the rather large bill due to paying the salaries of both the removed teachers and the substitute teachers or ATRs (members of the Absent Teacher Reserve) who cover for them.
4) You were one of the people who had advocated a gay marriage / civil unions bill. Furthermore, you and your colleagues preached about equal rights for gays and lesbians, and how they should have the same benefits as heterosexual couples. I now inform you that your efforts have not been a complete success. I have a friend whom you met several times at the Queens and Manhattan gay parades. He and his partner were married in New Jersey where they both lived. They both worked in New York City, though. My friend’s spouse recently passed away. He worked for Foot Locker which was doing business in New York City. Therefore, my friend should be covered under New York State inheritance laws. The deceased had a pension which the surviving spouse should be entitled to. Nonetheless, Foot Locker is telling him that since gay marriage civil unions are not recognized under Federal law, Foot Locker doesn’t have to award the surviving spouse the pension. In my opinion, this makes absolutely no sense, whatsoever.
I understand you would like to be the next Mayor of New York City. As of today’s date, I regret to inform you that I can’t possibly support you in this goal based on your ongoing unresponsive nature. Have you not publicly stated that everyone has a voice and that you would listen to everyone’s concerns?
I would very much appreciate it if you were to personally look into numbered paragraphs 1 to 4 above.
